Blog Entry 101 of 124 Revolution Anyone?
Remember the rise and fall of Rome? Well, it's happening again -- right here in our own country. Historians tell us that the United States is in its last phase of social and financial decline (as if intelligent and rational Americans didn't already know that). Americans who have been paying attention know that our legal system appears to be irreparably broken, and that our local, state and federal governments appear to be in corrupt shambles. Illegal aliens (most from Mexico) appear to be taking over our country. I also read (from reputable and reliable sources) that the United States, Canada and Mexico have plans to merge into one country. Can intelligent and rational Americans peacefully stop this madness? Or will there be another bloody American Revolution? Those two questions are what this blog is all about. Please join me in discussing what steps We The Intelligent And Rational People need to take to turn our country around before it's too late. Jan Jackson

WARNING !!!
HOMEOWNERS ASSOCIATIONS RISING !!!
California's financially destructive-to-homeowners laws

April 04, 2008

The "Davis-Stirling Act," mentioned in the American Homeowners Resource Center (AHRC) editorial HOMEOWNER ASSOCIATION BILL 1921 SHATTERS AMERICAN DREAM! - The California Legislature Should Abandon Assembly Bill 1921 (Saldana), March 31, 2008, by Donie Vanitzian, Sacramento,is California's legislative Act which is composed of many dictatorial homeowners association (HOA) laws which are very similar to Colorado's ecologically and financially destructive-to-homeowners Common Interest Ownership Act (CCIOA) laws/statutes.

When the author of the below editorial (who is an attorney in California and who is also very knowledgeable about the facts and laws of homeowners associations there) writes that the California Law Revision Commission is, in her legal opinion, "ba*tardizing the Davis-Stirling Act," she could also be referring to what our Colorado legislature is doing, has been doing, to our HOA laws (CCIOA) for the past several years. That is, our legislators and Governor are making bad laws concerning HOAs even worse by amending them, deleting them, or adding new words to them.

When the author of the below editorial writes that California's newest proposed HOA bill, AB 1921, is the full employment act for special interest parasitic industries and California's legislators" and that her legislature's new bill is "bad legislation," she could also be writing about any one of our Colorado legislature's destructive-to-homeowners amendments (House and Senate bills) since 1992, or its original HOA laws/statutes (CCIOA) which were signed into law by the then Governor of Colorado in 1992.

When the author writes that even though "they [California's legislators] may fancy themselves oracles of legislation," they are instead masters of self-delusion," she could also be writing about any one of our Colorado legislators -- especially Representative Morgan Carroll and Senator Bob Hagedorn -- who first sponsor new HOA bills, then seek (and get) unanimous approval of them in both the House and the Senate. By the time new HOA bills go to our Governor to sign, it's all a done deed.

When the author writes that "these public sector parasites are rarely held accountable for the disasters they cause" she could also be writing about our Colorado "public sector parasites" who appear to not represent We The People of Colorado at all, but only represent their own personal power and money interests.

When the author writes about California's "battle-scarred minefield memorializing the delusions of self-congratulatory legislators wanting their names in books of California law -- at any cost," and "the bigger the special interest payments" to them, she again could be writing about Colorado's "special interests" organizations, i.e., Community Associations Institute's (CAI) lawyers-lobbyists, developers, builders, and everyone else who becomes very wealthy by taking lotsa money right out of the pockets of hard-working homeowners as a result of what certainly appears to be collusion between these "special interests" and Colorado legislators which result in destructive-to-homeowners HOA laws.

When the author writes about "the end game" of California's newest HOA bill being "prohibitively expensive litigation," she could also be writing about HOA homeowners in Colorado who dare to challenge the dictatorial practices of their HOAs' lawyers and boards of directors and, as a result, lose their homes to foreclosure as well as most of the money they've saved by working hard for all of the lives.

When the author writes about California legislators "Hiding reality under the guise of 'legis-speak' lest their intent be exposed," she could also be writing about any of our smiling, seemingly affable and concerned about the needs of their constituents, Colorado legislators who will say anything to get elected or reelected but really don't mean a word they say.

And when the author writes that the new California proposed HOA bill "amounts to condemning owners to subjugate their rights to the whim of their rulers, be they boards, legislators, vendors, attorneys, judges, arbiters, or the like." And that "It is an 'implicit submission' to forces outside the homeowner's control," she could also be writing about the power-and-money seekers of many Colorado's legislators, CAI lawyers-lobbyists, HOA lawyers, HOA Presidents and boards of directors, politically-connected judges, or any other Colorado group who can "rule over" (control) the money and lives of all homeowners who live in Colorado's HOAs.

When the author writes about the California legislature "shamelessly mischaracterizing an intentional revision ba*tardized of form and substance," it is reminiscent of a new Colorado HOA bill a few years ago where Representative Carrol and Senator Hagedorn told We The People in the entire state of Colorado that the bill was simply a "cleanup" bill, i.e., grammar, punctuation, etc, when in reality it was a very important bill that significantly altered the lives of HOA homeowners throughout Colorado.

Political revolutions in California and Colorado anyone?
